Accommodation Statement

The Americans with Disabilities Act (ADA) requires state and local government to take steps to ensure that their
communications with people with disabilities are as effective as communications with others. The effective communication requirement applies to all members of the public with disabilities, including job applicants, program participants, and even people who simply contact state or local government agencies seeking information about programs, services, or activities.

Additionally, the HCRMA ensures its programs will be conducted, and its facilities operated, in compliance with all non-discriminatory practices and requirements imposed by or pursuant to 49 Code of Regulations (CFR) Part 27, 28 CFR Part 35 and 42 USC §12101-12213.

DENIAL OF REQUEST

The HCRMA is required to provide effective communications with people with disabilities except where it can show that providing effective communication would fundamentally alter the nature of the service or program in question or would result in an undue financial and administrative burden.

The decision to deny a request will be made only after consideration of the funding available in the current operating budget. If a request is denied because it results in an undue financial and administrative burden to the HCRMA, the HCRMA will take another action that will not result in an undue financial and administrative burden and would ensure that the individual with a disability receives the benefits or services provided.
